class=\"fusion-text fusion-text-2\" style=\"--awb-margin-top:0px;\"><p><strong>\u2013 relativa a la protecci\u00f3n de las personas que informen sobre infracciones del Derecho de la Uni\u00f3n<\/strong><\/p>\n<blockquote>\n<p>Las empresas con m\u00e1s de <b>50 empleados <\/b>y las <b>entidades p\u00fablicas con m\u00e1s de 10.000 habitantes<\/b> est\u00e1n sujetas a la obligaci\u00f3n de establecer <b>canales de denuncia<\/b>. Las empresas de entre 50 y 249 personas trabajadoras dispondr\u00e1n de un per\u00edodo transitorio de dos a\u00f1os para ello, es decir, hasta el 17 de diciembre de 2023.<\/p>\n<\/blockquote>\n<p>La Directiva asegura que los denunciantes puedan reportar, internamente y a las autoridades p\u00fablicas, de cualquier infracci\u00f3n de la normativa europea que se produzca en el seno de una organizaci\u00f3n a trav\u00e9s de <b>canales que garanticen la seguridad<\/b> del <i>whistleblower.<\/i> Entre las \u00e1reas que cubre la nueva Directiva, destacan la contrataci\u00f3n p\u00fablica, salud p\u00fablica, blanqueo de capitales, seguridad del transporte, protecci\u00f3n del medio ambiente o competencia.<\/p>\n<p>Tanto los canales internos como externos de denuncia deben preservar la<b> confidencialidad del denunciante<\/b> o sujetos terceros relacionados con aquel. La definici\u00f3n de denunciante, bajo el paraguas de protecci\u00f3n de la Directiva, engloba a trabajadores, personas en situaci\u00f3n de dependencia econ\u00f3mica de la empresa, contratistas y proveedores, entre otros.<\/p>\n<p>Es una normativa cuya finalidad es favorecer la tarea de los denunciantes o <i>whistleblowers<\/i>, pero que tambi\u00e9n proporciona grandes beneficios a las empresas, al promover una cultura interna basada en la legalidad, el compliance y la detecci\u00f3n de comportamientos poco \u00e9ticos en fases tempranas.<\/p>\n<p>Los datos personales de denunciantes y denunciados deben ser tratados de acuerdo a la normativa de <b>protecci\u00f3n de datos europea (RGPD<\/b>) o de las leyes de protecci\u00f3n de datos particulares de cada Estado Miembro (en el caso de Espa\u00f1a, la LOPDGDD).<\/p>\n<p><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/ES\/TXT\/PDF\/?uri=CELEX:32019L1937&amp;qid=1575015005541&amp;from=ES\" class=\"fusion-text fusion-text-4\"><p>El objeto del convenio es garantizar que cada Estado contratante incluya en su derecho interno procedimientos eficaces en favor de las personas que hayan sufrido da\u00f1os resultantes de actos de corrupci\u00f3n, con el fin de permitirles defender sus derechos e intereses, incluida la posibilidad de obtener indemnizaci\u00f3n por dichos da\u00f1os.<\/p>\n<p>Entre las medidas de obligado cumplimiento por los Estados se incluyen las referidas a la protecci\u00f3n de los empleados que tengan motivos fundados de sospecha de
