font-family: Roboto; font-size: 24px;\" data-fusion-font=\"true\" data-fusion-google-font=\"Roboto\" data-fusion-google-variant=\"700\">EU Whistleblower protection<\/span><\/p>\n<\/div><div class=\"fusion-text fusion-text-2\"><p><strong style=\"font-size: 18px; font-family: Roboto; font-weight: 300;\" data-fusion-font=\"true\" data-fusion-google-font=\"Roboto\" data-fusion-google-variant=\"300\">Protection of persons reporting on breaches of Union law<\/strong><\/p>\n<p>European Council adopted rules on <strong>whistleblower protection<\/strong>. The rules require the <strong>creation of safe channels<\/strong> for reporting both within an organization \u2013 private or public \u2013 and to public authorities. It also provides a high level of protection to whistleblowers against retaliation and requires national authorities to adequately inform citizens and train public officials on how to deal with whistleblowing.<\/p>\n<p>The main elements of the compromise include:<\/p>\n<\/div><ul style=\"--awb-line-height:23.8px;--awb-icon-width:23.8px;--awb-icon-height:23.8px;--awb-icon-margin:9.8px;--awb-content-margin:33.6px;\" class=\"fusion-checklist fusion-checklist-1 fusion-checklist-default type-icons\"><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon awb-icon-check\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">\n<p>Creation of channels of reporting within companies\/administrations: all companies with <b>more than 50 employees<\/b> will have to set up an internal procedure to handle whistleblowers\u2019 reports. All state, regional administrations, and <b>municipalities with over 10,000 inhabitants<\/b> will also be covered by the new law.<\/p>\n<\/div><\/li><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon awb-icon-check\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">\n<p>Hierarchy of reporting channels: whistleblowers are encouraged to use <b>internal channels<\/b> within their organization first, before turning to external channels which public authorities are obliged to set up.<\/p>\n<\/div><\/li><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon awb-icon-check\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">\n<p>Feedback obligations for authorities and companies: obligation to respond and follow up to the whistleblowers\u2019 reports <b>within 3 months<\/b> (with the possibility of extending this to 6 months for external channels in duly justified cases).<\/p>\n<\/div><\/li><\/ul><div class=\"fusion-text fusion-text-3\" style=\"--awb-margin-top:32px;\"><p><b><a style=\"--awb-text-transform:none;\"><p>On February 21, Spain&#8217;s Official State Gazette (BOE) published <strong>Law 2\/2023<\/strong> on the protection of persons who report breaches of law and the fight against corruption, which <strong>will enter into force on March 13<\/strong>. The whistleblowing law incorporates into Spanish law Directive (EU) 2019\/1937, establishing minimum standards with which reporting channels must comply.<\/p>\n<p>The law requires <strong>companies with 50 or more employee<\/strong>s to have an internal reporting channel and establishes <strong>fines of up to 1,000,000 euros<\/strong>.<\/p>\n<p>Key aspects:<\/p>\n<\/div><ul style=\"--awb-line-height:23.8px;--awb-icon-width:23.8px;--awb-icon-height:23.8px;--awb-icon-margin:9.8px;--awb-content-margin:33.6px;\" class=\"fusion-checklist fusion-checklist-2 fusion-checklist-default type-icons\"><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon awb-icon-check\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">\n<p>Organizations with <strong>250 or more employees<\/strong> have <strong>three months<\/strong> from the date the law comes into force, that is until <strong>June 13<\/strong>, to implement the required measures. The <strong>Portuguese Whistleblowing Law<\/strong> is called <em>\u201cRegime geral de prote\u00e7\u00e3o de denunciantes de infra\u00e7\u00f5es (RGPDI)\u201d<\/em>, that means \u201cgeneral whistleblower protection scheme\u201d.<\/p>\n<p><strong>As of June 18, 2022, all private and public entities with 50 or more employees and municipalities with 10,000 or more inhabitants must establish internal reporting channels.<\/strong><\/p>\n<p>Portuguese branches of companies with foreign headquarters are also subject to this rule.<\/p>\n<p>Reporting channels within the organization must include the following requirements:<\/p>\n<\/div><ul style=\"--awb-line-height:23.8px;--awb-icon-width:23.8px;--awb-icon-height:23.8px;--awb-icon-margin:9.8px;--awb-content-margin:33.6px;\" class=\"fusion-checklist fusion-checklist-4 fusion-checklist-default type-icons\"><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon awb-icon-check\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">\n<p>It is necessary to <strong>establish and operate channels for receiving reports<\/strong> that are designed, set up, and managed in a manner that guarantees the <strong>confidentiality of the identity<\/strong> of the reporting person and any third party mentioned in the report, and that prevents unauthorized staff from accessing it.
